By accessing or using XSendFlow ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
XSendFlow is a cold email outreach automation platform that allows users to create, schedule, and send email campaigns to recipients. The Service is provided on a subscription basis.
You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
You agree to use the Service only for lawful purposes. You must not use XSendFlow to send unsolicited bulk email (spam), to send emails to recipients who have not provided appropriate consent under applicable law, to distribute malware or phishing content, to impersonate others, or to violate any applicable laws including CAN-SPAM, GDPR, CASL, or Indian IT laws. You are solely responsible for the content of emails sent through the Service and for obtaining any required consents from your recipients.
Access to XSendFlow requires a paid subscription. Subscription fees are charged at the time of purchase via Razorpay. All prices are listed in USD and INR. Fees are non-refundable except as expressly stated in our Refund Policy. We reserve the right to change pricing with reasonable notice.
Each subscription plan has defined limits on campaigns, daily emails, sender accounts, and contacts. Exceeding plan limits will result in requests being blocked until you upgrade your plan. XSendFlow reserves the right to suspend accounts that abuse plan limits.
All content, software, and technology comprising XSendFlow is owned by XSendFlow and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
Your use of the Service is also governed by our Privacy Policy. You retain ownership of data you upload to the Service. By using the Service, you grant XSendFlow a limited license to store and process your data solely to provide the Service.
The Service is provided "as is" without warranties of any kind. XSendFlow does not warrant that the Service will be uninterrupted, error-free, or that emails will be successfully delivered. Email deliverability depends on many factors outside our control including recipient mail servers and spam filters.
To the maximum extent permitted by law, XSendFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of revenue, data, or business opportunities.
We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your subscription at any time through your account settings. Termination does not entitle you to a refund.
These Terms shall be governed by the laws of the Province of Ontario, Canada and the applicable laws of India, without regard to conflict of law provisions. Disputes shall be resolved through binding arbitration or in the courts of Mississauga, Ontario, Canada.
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notice.
